The CBCRA objects to this application.

The CBCRA is firmly of the opinion that restrictive title deed conditions can only be removed or amended under very specific conditions and the City’s reliance on the selective application of applicable legislation is flawed, if a proper reading of s25 of the Constitution is made.

It is of further concern that it would appear as if the construction pertaining to the setback departure and restrictive title deed deletion is, at least, partially completed.

The CBCRA is prepared to facilitate discussions between the applicant and affected parties in an attempt to reach a suitable agreement between the parties and achieve an outcome that is beneficial to all.

The CBRRA requests an interview at the MPT committee meeting, which will be convened to decide this application.
