Hi Jolene

Russell has supplied a surveyor’s certificate, attached below, indicating that the cast concrete level of the garages is 51,15m amsl (above mean sea level). The previous level of the old garage was given as 51,65m amsl.

The maximum permissible height of the new building may not exceed 60,44m amsl, so he has 9,23m to work within. The original agreement indicated the height of the building at 8,8m but that was a flat roof, so the difference of 430mm will be used by the “flip-up” roofs, with the 60,44m amsl being non-negotiable. I hope that this makes sense.
The floor to floor top of concrete dimension is indicated as 2,75m. I’ll check that on site now that he has the formwork in place. I’ll also request (again) that he puts up a profile that indicates the 60,44m mark.

Insofar as the windows are concerned, I’ll check with Mark, as he had more detailed agreements with Russell in this regard.

I hope you are well. I am from 67 Camps Bay Drive. We met at the meeting.
Would you be able to advise as to what has transpired since the meeting? I see that they are starting to lay the slab for the next floor. Was the height issue resolved?
I am particularly concerned about the change of windows on the plans overlooking my property and know that Mark has the same concerns.
Just don't want the build to continue without these issues resolved as dealing with them after the fact is going to be complicated.

It’s extremely easy to put up the mast with the contractor on site - just a scaffolding tower. Then the neighbours know what the visual height is going to be.

I have had no word from Gordon Hart regarding the survey details for Erf 1141, so I must presume that it is unavailable due to the passage of time.

However, the Agreement does record the existing height of the garage (51,65m amsl) and the apex of the roof (60,84m amsl). This is benchmarked off a survey beacon (27F12) at 54,80m amsl.

Please would you request the original surveyors, Jennings Goullee Thomson, to establish the height of the current garage and put in a survey mast showing the maximum height of the development, which is 60,44m amsl as per para 2.3 of the Agreement.

This request is made in terms of para 2.2 of the Agreement.

Mark, will you pass this on to the other affected neighbours, please.
